He
further advised that the alley to the north of the alley now under
discussion, had been vacated some years ago through a similar pro-
cess, and also carried a city easement for utility purposes.

In response to a question from Mayor Benke, Mr. Mattila noted that
the construction of permanent structures are not allowed on an ea-
sement such as this, thereby allowing the maintenance capabilities
by the City.

Being no comments from the audience, Motion by Williams, seconded
by Gunderman, to CLOSE THE PUBLIC HEARING.

5 Ayes - 0 Nayes, Motion carried.

Motion by Gunderman, seconded by Larson, to ADOPT A RESOLUTION TO
VACATE THE ALLEY IN BLOCK 6, FIRST ADDITION TO NEW BRIGHTON, AND
ESTABLISH A UTILITY EASEMENT OVER THE FULL LENGTH AND WIDTH OF SU-
BJECT ALLEY.

5 Ayes - 0 Nayes, Motion carried.

Page 3

Audit Adjustments
Report 88-169
Resolution 88-57

Gazebo/Veterans Park
Report 88-170

Veterans Park
Landscaping
Report 88-171

Budget Change/
Recycling
Report 88-172
Resolution 88-58

Public Hearings

Vacate Alley
North of 7th St./
South of Old Hwy 8
Report 88-173
Resolution 88-59
