Public Hearings City Planner Erny Mattila reviewed the alley in Block 6, First Ad- dition to New Brighton, laying south of 7th Street and north of Old Highway 8; noting this vacation request was as a result of a petition of abutting residents. He indicated staff was recommending the City retain an easement for utility purposes over the alley, specifically to allow main- tenance of the sanitary sewer line going through the alley. He further advised that the alley to the north of the alley now under discussion, had been vacated some years ago through a similar pro- cess, and also carried a city easement for utility purposes. In response to a question from Mayor Benke, Mr. Mattila noted that the construction of permanent structures are not allowed on an ea- sement such as this, thereby allowing the maintenance capabilities by the City. Being no comments from the audience, Motion by Williams, seconded by Gunderman, to CLOSE THE PUBLIC HEARING. 5 Ayes - 0 Nayes, Motion carried. Motion by Gunderman, seconded by Larson, to ADOPT A RESOLUTION TO VACATE THE ALLEY IN BLOCK 6, FIRST ADDITION TO NEW BRIGHTON, AND ESTABLISH A UTILITY EASEMENT OVER THE FULL LENGTH AND WIDTH OF SU- BJECT ALLEY. 5 Ayes - 0 Nayes, Motion carried.
