<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />June 14, 1988 <br /> <br />City Manager Hank Sinda, reviewed the actions leading up to the <br />Litigation Settlement, noting that in November, 1987, a "settle- <br />ment in principle" was announced, with the actual details to be <br />worked out; and at this time, approximately 99% of those details <br />appear to have been concluded. He further noted that City Council <br />action on the resolution now before them would authorize execution <br />of that agreement pending no substantive changes; however, even <br />though the authorization for execution would be approved at this <br />meeting, it could not be made public until it was actually ready <br />for signatures (in about two weeks). He emphasized that the City, <br />after hundreds of hours of work by the Council, City Staff, and <br />Attorneys to get to this point, felt it was a fair agreement. <br /> <br />Motion by Benke, seconded by Larson, to ADOPT A RESOLUTION APPROV- <br />ING LITIGATION SETTLEMENT AGREEMENT AND GENERAL RELEASE AND AUTHO- <br />RIZING ITS EXECUTION. <br /> <br />5 Ayes - 0 Nayes, Motion carried. <br /> <br />Gary Berger reviewed the recommendation of the Citizen Study Com- <br />mittee, following their meeting with the Garden Grove Apartments <br />residents, to deny the petition to allow overnight parking on 5th <br />Street. <br /> <br />Tom Bergstrom and Pam Schmitz of the Citizen Study Commission were <br />present to answer questions by the Council, noting that an addi- <br />tional 8 parking spaces had been obtained by restriping the park- <br />ing lot. The Council commended the Commission for the considera- <br />ble effort they had put into resolving this issue. <br /> <br />Motion by Gunderman, seconded by Brandt, to DENY THE PETITION RE- <br />QUESTING OVERNIGHT PARKING ON 5TH STREET S.W. <br /> <br />5 Ayes - 0 Nayes, Motion carried. <br /> <br />Mayor Benke announced that a number of issues had arisen relative <br />to the naming of the Bond Counsel for the City, and would, there- <br />fore, request that the matter be referred back to the Selection <br />Committee. <br /> <br />Motion by Benke, seconded by Gunderman, to REFER THE NAMING OF THE <br />BOND COUNSEL FOR THE CITY BACK TO THE SELECTION COMMITTEE. <br /> <br />5 Ayes - 0 Nayes, Motion carried. <br /> <br />City Engineer Les Proper, outlined the problems with the intersec- <br />tion at 11th Avenue and 8th Street, noting geometrics and the man- <br />ner in which the area was developed as the primary cause.
