As this is a heavy industrial district, there would seem to be
no question about this use being permitted in the district by means
of the special use permit so long as necessary perJlcrmancecon-
ditions related to the operation of their business are observed.
In this regard, the principal problem is air pollution. There are
controls in City ordinances regarding an operation of this type..
The first is Section 10-130 (h) of the Zoning Code in the .
industrial performance standards. Additionally, this business
is required to have: an',~0i€1fienshlei3t.l?ad$s-' license:~: as proyieed, for:~
in Section 860 of the City Code which establishes certain con-
ditions on their operation. Odors have been detected
by the Administration, through present evidence does not defini-
tively prove that the odors al:'e eminating from the applicant's
plant. As mention in the NC-ll discussion, it is difficuit to
determine the origin of tjle odors because of the proximity to
Gordon Rendering, wind direction, hours of operation, and because
there are no specific regulations requiring periodic pollution
control tests. It would appear that stack tests, samples of the
discharge from the plant smoke stack, would be ~equired to
definitiv~lY1':esl:a.bli.li.sh if performance standards are being met.
According to the City Sanitarian, stack tests regarding o~or are
conducted by a private firm at an approximate cost of $300.00.

Sl?-72, Council approval of special use permit to change
existing non-conforming-rendering plant to a permitted
use.

The MengelkochCompany

119 - 14th St. NW

I-2

is 'requestingthe necessary approvals t.o change
the existing use toa permitted llse. in order 'to allow expansion
oftheren.dering plant.
