<br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN AMENDMENT <br />TO SPECIAL USE PERMIT, SP-78. <br /> <br />. <br /> <br />WHEREAS, an application for a special use permit has been <br />made by the Rice Creek Shopping Center; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for an amendment to SP-78 was <br />filed with the City on March 14, 1984. <br />2. That the applicant requested that the public hear- <br />ing date be held in April. <br />3. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on April 17, <br />1984, all persons present at the hearing were given <br />an opportunity to be heard. <br />4. That the application for an amendment to SP-78 was <br />reviewed by the City Council on April 24, 1984. <br />5. That the comments and analysis of Staff and the <br />Planning Commission minutes and recommendations <br />were considered. <br /> <br /> <br /> <br />NOW THEREFORE BE IT RESOLVED that the City Council makes the <br />following Findings of Fact in respect to amending SP-78: <br /> <br />1 . <br />2 . <br />3. <br /> <br />That the Shopping Center is an area of special control <br />which merits special signing consideration. <br />That the shape of the shopping center does not make <br />tenant wall signs easily visible from Silver Lake Road. <br />That the need for a ground sign listing the names of the <br />Shopping Center tenants has been expressed as an ongoing <br />need by the shopping center management, past and present <br />That the overall area and height of the ground sign, as <br />indicated in the shopping center sign plan, will not be <br />increased. <br /> <br />4. <br /> <br />, <br />f <br />, <br />I <br />I BE IT FURTHER RESOLVED that the application for an amendment <br />L to SP-78 is and hereby approved subject to the following con- <br />i: ditions: <br /> <br />I <br />I <br />, <br /> <br />1. <br /> <br />That the following item of the sign plan approved on <br />December 27, 1977 be amended under Section "Ground <br />Signsll to read: <br /> <br />1. The Center shall be identified by a single ground <br />sign with an overall area of 104 square feet. As <br />shown on exhibit H-1 the sign shall have an 8 foot <br />x 1 foot 4 inch panel stating "Rice Creek Center", <br />an 8 foot x 11 foot 6 inch copy board with 20-3 foot <br />6 inch x 1 foot tenant 1.0. spaces per side, a 6 <br />foot 9 inch pole, a 1 foot 5 inch high brick planter <br />and a 2 foot" sh i n 9 1 e - t Y P e top" .
