<br />e' <br /> <br />e <br /> <br />. <br /> <br />Ii <br />I <br /> <br />t. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON, <br /> <br />RESOLUTION ~~KING FINDINGS OF FACT AND APPROVING APPLICATION FOR SPECIAL USE <br />PERMIT, SP-96 , <br /> <br />WHEREAS, An application for a special use permit entitled SP-96 has <br />been made by PDQ Food Stores to permit the sale of gasoline and construction <br />of one gasoline service station. <br /> <br />WHEREAS, The procedural history of the application is as follows: <br /> <br />1. That an application for special use permit, SP-96 was filed with the <br />City of New Brighton on February 25, 1981. <br />2. That such application was reviewed by the New Brighton Planning <br />Commission Board of Review on March 17, 1981. <br />3. That the City Council, pursuant to published and mailed notices, held <br />a public hearing on April 14,1981 and May 12,1981, all person1s <br />present at the hearing were given an opportunity to be heard. <br />4. The written comments and analysis of the City staff, the Planning <br />Commission minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City Council makes <br />the fOllowing Findings of Fact in respect to SP-96: <br /> <br />1. That the property is zoned B-2, Neighborhood Business; <br />2. That there are commercial uses to the east and an apartment complex <br />to the north and west; <br />3. That the site is located on a major thoroughfare, County Road 11011; <br />4. That the proposed use will not adversely affect the surrounding land <br />uses; and <br />5. That the use of gasoline sales is designed for local or.neighgorhood <br />use and will not be regional in nature. <br /> <br />BE IT FURTHER RESOLVED, That the application for special use permit, <br />SP-96, is and hereby approved contingent on the following conditions: <br /> <br />1. That the location of the service island and pumps conforms to the <br />site plan dated and signed by the applicant and City Planner; <br />2. That the open area west of the service island be sodded and contain <br />p1antings to screen the pumps and be well-maintained; and <br />3. That there be no outside storage or display of gasoline related <br />merchandise. <br /> <br />Adopted this <br /> <br />day of <br /> <br />, 1981. <br /> <br />James W.
