<br />., <br /> <br />RESOLUTION NO <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION NAKING FINDINGS OF FACT AND RECOM~1ENDING APPROVAL OF SPECIAL USE <br />PERMIT, SP-98 <br /> <br />WHEREAS, An application for a special use permit, SP-98 has been made by <br />Belair Builders and John Johnson to excavate material from a site zoned <br />R-l, Single Family Residential. <br /> <br />WHEREAS, The procedural history of the application is as follows: <br /> <br />1. That an application for a special use permit, SP-98 was filed with. <br />the Ci ty on May 13, 1981.. <br />2. That the Board of Review heard and reviewed the application at its <br />regular meeting on May 19, 1981. <br />3. The written comments and analysis of the City Planner and all <br />person's statements made at the Board of Review meeting were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED By the Board of Review that the following <br />Findings of Fact are made in respect to SP-98: <br /> <br />1. That the property is zoned R-l, Single Family Residential; <br />2. That the pr~perJY has been mined in the past and has a large <br />deposit of fill material; <br />3. That the excavation site is close in proximity to the <br />development site and therefore reduces the baulinq distance: and <br />4. That the proposed route is designed to be removed from residential <br />areas and utilizes major thoroughfares of County Road E and Silver <br />Lake Road and should not have adverse affect on those areas <br />residents and roadways. . <br /> <br />BE IT FURTHER RESOLVED That ,the Board of Review hereby recommends <br />approval of special use permit SP-98 contingent on the following: <br /> <br />1. That site restoration plans are approved by the City Engineer; <br />2. That the applicant post a performance bond in the amount of <br />$20,000.00 to assure the City of proper site restoration; .: <br />3. That the excavation/special use permit expires 60 days after the <br />date of approval; and <br />4. That the applicant conform with excavation,- fill and grading plans <br />approved by the!City Engineer. <br /> <br />Adopted this <br /> <br />day of <br /> <br />, 1981. <br /> <br />Wayne Leverkuhn, Chairman <br /> <br />Joan M.
