<br />.y <br /> <br />May 15,1981 <br /> <br />APPLICATION FOR SPECIAL USE PERMIT <br />SP-98 BELAIR BUILDERS <br /> <br />PURPOSE <br /> <br />To consider a request for a special use permit to excavate material <br />from a site zoned R-l, Single Family Residential. <br /> <br />BACKGROUND <br /> <br />APPLICANT: <br />LOCATION: <br /> <br />EXISTING ZONING: <br />EXISTING USE: <br />ZONING CODE REGULATIONS: <br /> <br />APPLICANT'S PROPOSAL: <br /> <br />Bel air B u i lde rs <br /> <br />Generally located south of 5th <br />Street N~, we~t of Silver Lake <br />Road and north of County Road E. <br /> <br />R~l, Single Family Residential <br /> <br />Vacant <br /> <br />Section 11-090 d. <br /> <br />See Attached Proposal <br /> <br />STAFF'S COMMENl'S <br /> <br />The applicant's proposal to extract material from a site that has been <br />mined in the past and transport it to a development site on the <br />southeast corner of Silver Lake Road and County Road E, appears to <br />have little impact on adjacent residents. The route selected by the <br />applicant is removed from residential properties with the exception <br />of a few homes along County Road E. <br /> <br />The approved condominium project requires at the time 10,000 cubic <br />yardsof fill and staff supports the proposal to bring that fill in <br />from a site close in proximity as not to affect very many residential <br />properties or interfere with traffic patterns. <br /> <br />The City Engineer has reviewed the excavation and fill plans for <br />the condominium site located generally the southeast corner of Silver <br />Lake Road and County Road E.He reported that the plans on the <br />condominium site were acceptable-but that he needed more information <br />con c ern i n g the ex ca v at i on t a kin g . p 1 ace 0 nth e 0 the r sit e . T his <br />matter is being addressed by the applicant. <br /> <br />There is a requirement for a performance bond to assure the City that <br />any public facilities that might be damaged are repaired and that <br />the two sites are restored to an acceptable state. In addition, <br />staff contends that a time limitation should be established so as to <br />reduce the time period that the ground on the "JUO" property is <br />disturbed. In regard to the time limit, the applicant has indicated <br />that the work will commence immediately after approval and take about <br />15 working days. <br /> <br />STAFF RECOMMENDATION <br /> <br />Staff recommends that the Board recommend approval of SP~98 by waiving <br />the reading and adopting the attached resolution. <br /> <br /> <br />/t1,~ <br /> <br />Archer, City Planner <br />
