<br />- <br /> <br />:) <br /> <br />" <br /> <br />RESOLUTION NO <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING APPLICATION FOR <br />SPECIAL USE PERMIT, SP-99 <br /> <br />WHEREAS, an application for a special use permit entitled <br />SP-99 has been made by Thomas Boudreau to construct an amateur <br />radio tower/antenna at~~O 23rd Avenue NW; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a special use permit was filed with <br />the City of New Brighton on September 3, 1981. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on October 1, 1981 <br />and October 20, 1981, all person's present at the hearing <br />were given an opportunity to be heard. <br />3 . That such a p p 1 i cat i 0 nw a s considered by the City Council <br />on December 8, 1981, <br />4. The written comments and analysis of the city staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to SP-99: <br /> <br />1. That the proposed site is zoned R-l, Single Family <br />Res i de n t i a 1 ; <br />2. That the overall height of the tower/antennae is 80+ feet; <br />3 . That the lotd~im e nS:l{H'F"~i-n-~q u est-:i-on,j-s~6 5. 7-f e e t -w id.e -and. <br />275.45 feet deep; <br />4. That the application does not meet the setback requirements <br />for the structure (Section 4-600 b.l and c.2.) the guy <br />anchors {Se~tion 4-600 b.2) and antenna devices (Section <br />4-600 b.2); and <br />5. That the tower does not meet the required setback from an <br />overhead electrical power line which serves more than one <br />dwelling (Section 4-600 6.5.) <br /> <br />BE IT FURTHER RESOLVED, that the application SP-99 is hereby <br />denied. <br /> <br />Adopted this <br /> <br />day of <br /> <br />, 1981. <br /> <br />James W.
