<br />ATTACHMENT A <br /> <br />STAFF COMMENTS <br /> <br />Of the requirements of Section 4-600 of the zoning code this application <br />does not meet the following: <br /> <br />1. Section 4-600 b. 1 - Tower/antennae setback must be 80 feet. A <br />guyed structure has a setback of 75% of the height or 60 feet. <br />(Section 4-600 c.2.) <br />2. Section 4-600 ~. 2 - A ten foot setback for guy anchorage or <br />similar devices is required. The guy anchor on the south side is <br />on the property line. <br />3. Secti'on 4-600 b. 5- There are above groundele-ctri-cal power1;nes <br />which are within the fall radius of the tower/antenna. <br />4. The Building Official is in addition requiring that a maintenan~e <br />program be submitted by the applicant. (Section 3-500 b.l.) <br />No such maintenance program has been submitted. <br />5. Section 4-600 c.2. requires that applications inVOlving guyed <br />structures include information concerning collapse radius of <br />the structure. No such infomation was provided. <br /> <br />On the basis that the proposed structure does not meet the requirements <br />of Section 4-600~ staff recommends denial of SP-99. <br /> <br />The applicant applied for this special use permit on September 3, 1981 <br />and a public hearing was scheduled for October 1, 1981. At the <br />request of the applicant, the Planning Commission continued the hearing <br />to October 20, 1981 at which time the Commission recommended denial of <br />the request. <br /> <br />Normally staff would have then placed the item on the October 27, 1981 <br />City Council agenda. The applicant requested that the Council consider <br />the application at its first meeting in December. Since that request <br />staff has received a request to delay consideration unitl the summer <br />of 1982. <br /> <br />Mr. Boudreau has also indicated that he wants a wind generator/flag <br />pole which would require a new separate application. <br /> <br />Staff has put this item on the Council agenda because of the concern <br />over the nature of the request. The applicant has already erected <br />the tower and the Planning Commission has recommended denial on the <br />basis that the tower/a~tennae does not meet code. The zoning code <br />section is based on the public health, safety, and general welfare and <br />should therefore be complied with. If the applicant had not already <br />erected the tower, staff would not be concerned about delaying <br />consideration until the summer of 1982. <br /> <br />Staff puts this item on the Council aqenda on the basis that this <br />request should beJdealt with expeditiously and based on the City having <br />already ~rovided for a number of delays. <br /> <br />l) <br />
