ATTACHMENT A STAFF COMMENTS Of the requirements of Section 4-600 of the zoning code this application does not meet the following: 1. Section 4-600 b. 1 - Tower/antennae setback must be 80 feet. A guyed structure has a setback of 75% of the height or 60 feet. (Section 4-600 c.2.) 2. Section 4-600 ~. 2 - A ten foot setback for guy anchorage or similar devices is required. The guy anchor on the south side is on the property line. 3. Secti'on 4-600 b. 5- There are above groundele-ctri-cal power1;nes which are within the fall radius of the tower/antenna. 4. The Building Official is in addition requiring that a maintenan~e program be submitted by the applicant. (Section 3-500 b.l.) No such maintenance program has been submitted. 5. Section 4-600 c.2. requires that applications inVOlving guyed structures include information concerning collapse radius of the structure. No such infomation was provided. On the basis that the proposed structure does not meet the requirements of Section 4-600~ staff recommends denial of SP-99. The applicant applied for this special use permit on September 3, 1981 and a public hearing was scheduled for October 1, 1981. At the request of the applicant, the Planning Commission continued the hearing to October 20, 1981 at which time the Commission recommended denial of the request. Normally staff would have then placed the item on the October 27, 1981 City Council agenda. The applicant requested that the Council consider the application at its first meeting in December. Since that request staff has received a request to delay consideration unitl the summer of 1982. Mr. Boudreau has also indicated that he wants a wind generator/flag pole which would require a new separate application. Staff has put this item on the Council agenda because of the concern over the nature of the request. The applicant has already erected the tower and the Planning Commission has recommended denial on the basis that the tower/a~tennae does not meet code. The zoning code section is based on the public health, safety, and general welfare and should therefore be complied with. If the applicant had not already erected the tower, staff would not be concerned about delaying consideration until the summer of 1982. Staff puts this item on the Council aqenda on the basis that this request should beJdealt with expeditiously and based on the City having already ~rovided for a number of delays. l)
