The <br />owner, Mr. Richard Ernst is requesting a ground sign of\124 <br />square feet. There appears to be a difference in interpreta- <br />tion of Section 9-180, Areas Of Special Control in the Zoning <br />Code. The Planning Commission has therefore asked me to write <br />you this letter and obtain the legal opinion pertaining to the <br />code. ' <br /> <br />As indicated by Section 9-180 b. 2. that shopping centers are <br />allowed to be indentified by a single ground sign to identify <br />the name of the center only. The applicant is applying for a <br />ground sign that identifies the name of the center and also to <br />contain a reader board with interchangable letters to advertise <br />individual businesses in the center. It is my interpretation <br />of the code that it states that the groundsiQn that is allowed <br />has no more than 5 items of information and identified the <br />center, not advertising individual businesses. The applicant <br />indicates under Section 9-180 b. 2. that the Council is generally <br />allowed to be more or less restrictive than the provisions of the <br />ordinance. <br /> <br />Staff feels that it is true that the City Council can be more or <br />less restrictive but in- the case of the shopping center I feel <br />under Section 9-180 b. 2. that it specifically states that the <br />ground sign for a shopping center can only identify the name of <br />the center. I would like to ha~e you read through this sign <br />ordinance especially the Section 9-180 b.2. and comment on <br />whether or not the code provides for or allows the type of reader 0 <br />board to be used for advertising for individual business as <br />requested by the applicant. <br /> <br />It also appears that there is some discrepency on the size of that <br />ground sign. Section 9-040 contains a table of basic design <br />elements which all signage in the City of New Brighton adheres <br />to. ' , <br />
