;

,

The property is zoned B-3, General Business and therefore the
ground sign area allowed is 64 square feet with a height of 20
feet. Under Section 9-180 b.2. it specifically states that an
application for a ground sign can exceed the height limitation
as defined in that table of basic design elements if demonstrat-
ed necessary. That section also indicates that Council can be
more or less restrictive than the table of basic design elements
therefore it would appear that a larger sign than 64 square feet
could be allowed if warranted. Therefore, it is my interpretation
that a larger sign than 64 square feet would be allowed under t~e
sign plan for the shopping center.

The Planning Commission will review this item on January 19, 1982
and I would appreciate it if you could possibly comment or respond
to this letter on Thursday, January 14, 1982. If possible, maybe
we could discuss the matter after the staff meeting on Thursday
morning. Since the Planning Commission has requested that I get
a legal interpretation of this code maybe it would be advisable
that your response be in writing.

Please contact me to let me know how we should proceed on this
matter.

Sincerely,

~4~

Joan M.
