SP-10l ~ <br /> <br />WHEREAS, An application for a special Use permit, SP-10l has been made by <br />Salem Baptist Church to use a single family dwelling as a classroom; and <br /> <br />WHEREAS, The procedural history of the application is as follows:, <br /> <br />1. That an application for a special use penmit was filed with the City <br />on November 3~ 1981. _ <br />2. That the Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on November 17, 1981, all person's present at <br />the hearing were given an Opportunity to be heard. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission that the following <br />Findings of Fact are made in respect to SP-101: <br /> <br />1. That the property is zoned R-1, Single Family Residential; <br />2. That the Church will use the property for one hour on SundaY,and 1~ <br />hour on Wednesday evenings; <br />3. That all parking is on the church parking lot not at the house location <br />4. That the establishment, maintenance or operations .of the special use <br />wi 11 not be detrimenta 1 to or endanger the pub 1 i c hea 1 th, sa fety , <br />morals, comfort or general welfare on the basis the conditions of <br />this approval are met; <br />5. That the above described'use will not be injurious to the use and <br />enjoyment of other property in the immediate Vicinity for the purposes <br />already permitted, nor sUbstantially diminish and impair property <br />values within the neighborhood; . <br />6. That the establishment of the special use will not impede:-the normal <br />and orderly development and improvement of the surroudnig property <br />for uses penmitted in the district; <br />7. That the .specia1 use does in all other resjpects, conform to the <br />applicable regulations of the R-l district. <br /> <br />BE IT FURTHER RESOLVED that the application SP-10l is and hereby <br />recommended for approval subject to the following conditions: <br /> <br />1. That any major modification of the proposed use be reviewed by the <br />City Council; <br />2. That a list of items to be conducted with an acceptable timetable tD <br />conform with the bUilding code be made a part of this approval; <br />3. That no special functions be allowed until all code violations are <br />abated; <br />4. That the applicant upon the approval of this application discontinue <br />classroom use of the furnace room; <br />5. That a performance bond be secured by the City in the amDunt of the <br />improvements to be made; and .4 <br />6. That failure to comply with the schedule/timetable for said improvement <br />makes this special use permit null and 90id. <br /> <br />Adopted this <br /> <br />day of <br /> <br />, 1981. <br /> <br />Roger S.
