Section 5-340 b. states that: <br /> <br />"Uses listed in Section 5-240 shall be allowed within the downtown <br />business district upon issuance of a special use permit," <br /> <br />B. Section 5-240 a. describes t~e proposed use that requires a speci~l <br />permit: <br /> <br />"a. Amusement and recreation, armory, assembly hall, bowling alley, <br />dance hall, pool and billiards, theather, skating rink or other <br />social sport, or recreation center operated as a business." <br /> <br />C. Section 8-130 lists the standards for review ~f a special use permit. <br /> <br />STAFF COMMENTS <br /> <br />There are three major areas of concern relating to the proposed use: <br /> <br />1) Lack of required parking spaces; <br />2) Dances require police officers on duty; and <br />3) Potential for the concentration of juveniles across the <br />street and in the same parking lot as the liquor store. <br /> <br />Parking <br /> <br />This type of use does not have a specially stated parking formula in <br />the zoning code. If the formula to be used for this social hall is to <br />be the same as Brandywine addition it would be 1 space for every 2 <br />seats. The proposal has approximately 200 seats which would require <br />100 parking spaces. If the private club calculation was used, 1 space <br />per 5 seats, 40 parking spaces are required. This is a public facility <br />and staff feels that the private club is not applicable. Even if the <br />requirement were between the two - 1 space per 3.5 - 57 spaces would be <br />required. <br />
