April 29, 1982
77/1// ,~

APPLICATION FOR SPECIAL USE PERMIT
SP-104, SGT. BILKOS INC.

PURPOSE

To consider a request for a special use permit to use a existing build-
ing as a dance hall.

~1J~

BACKGROUND
APPLICANT:

Sgt. Bilkos Inc.
Jim Hanna
,

LOCATION:

553 - 9th Street NW
(South of the Munie - Old Post Office
Building)

B-4, Downtown Business District

Dance Hall/Social Center
(See attached applicant's letter)
s;t',Aa.'5 /Je?/CfT
~iAAJ p--f ~ ;-0 -'Z-(/ elf
tJ 57 -~ - '?:Jj
/t-v...~ "- 7-1

ZONING:
PROPOSED USE:

PERTIENT CODE REGULATIONS

A. Section 5-340 b. states that:

"Uses listed in Section 5-240 shall be allowed within the downtown
business district upon issuance of a special use permit,"

B. Section 5-240 a. describes t~e proposed use that requires a speci~l
permit:

"a. Amusement and recreation, armory, assembly hall, bowling alley,
dance hall, pool and billiards, theather, skating rink or other
social sport, or recreation center operated as a business."

C. Section 8-130 lists the standards for review ~f a special use permit.

STAFF COMMENTS

There are three major areas of concern relating to the proposed use:

1) Lack of required parking spaces;
2) Dances require police officers on duty; and
3) Potential for the concentration of juveniles across the
street and in the same parking lot as the liquor store.

Parking

This type of use does not have a specially stated parking formula in
the zoning code. If the formula to be used for this social hall is to
be the same as Brandywine addition it would be 1 space for every 2
seats. The proposal has approximately 200 seats which would require
100 parking spaces. If the private club calculation was used, 1 space
per 5 seats, 40 parking spaces are required. This is a public facility
and staff feels that the private club is not applicable. Even if the
requirement were between the two - 1 space per 3.5 - 57 spaces would be
required.
