<br />-2- <br /> <br />There is a parking lot behind the building that could if designed, <br />properly accommodate 26 parking spaces. It should be noted that there <br />are two other tenants in that building that use this area for their <br />off-street parking. This area of 26 spaces results in the following <br />parking dificiencies: <br /> <br />1) 1 space per 2 seats - deficit of 74 spaces <br />2) 1 space per 5 seats deficit of 14 spaces <br />3) 1 space per 3.5 seats - deficit of 31 spaces <br /> <br />The parking lot across the street is City owned and cannot be con- <br />sidered a "Municipal Parking Lot". It is a parking lot for a City <br />owned business - the liquor store and the parking spaces are needed <br />(required) for that liquor operation. There are only 37 spaces on <br />the west side of the liquor store building and even if they were <br />surplus would not meet the above deficiencies except #2. <br /> <br />Dances & Juvenile Usage <br /> <br />The New Brighton Police Department and Liquor Department have voiced <br />their concerns about this proposed use in the attached memos. An area <br />business owner also has submitted a letter because he is unable to <br />attend the public hearing and would like it made a part of the record. <br /> <br />These letters address the other two issues of police involvement with <br />dances and the mix of juveniles with the liquor store operation. The <br />applicant has stated that he desires an operation for adults but <br />staff is concerned that his desire would not be realized. There is no <br />law that staff is aware of to restrict minors from using this facility. <br />The applicant, because of the dances would have to hire an off-duty <br />policeman to monitor the operations. <br /> <br />SUMMARY <br /> <br />The major objection to this proposed use based on the zoning code is <br />the lack of 40 to 75 parking spaces that would be required for this <br />type of use. <br /> <br />RECOMMENDATION <br /> <br />To recommend denial of SP-104 by waiving the reading and adopting the <br />attached resolution. <br /> <br />
