<br />RESOLUTION NO <br /> <br />e <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />SPECIAL USE PERMIT, SP-105 <br /> <br />WHEREAS, an application for a special use permit entitled <br />SP-105 has been made by Minnesota Transportation Museum and New <br />Brighton Historical Society to use an industrial site for a <br />transportation museum site. <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for spe~ial use permit, SP-105 was <br />filed with the City of New Brighton on June 4, 1982. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on July 20, 1982, <br />August 17, 1982, all person's present at the hearing were <br />given an opportunity to be heard. I <br />3. That such application was reviewed by the City Council on <br />August 24, 1982. <br />4. The written comments and analysis of the city staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />e <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to SP-105: <br /> <br />1. That the property is zoned 1-2, Heavy Industrial with a <br />pending rezoning of 1-3, Limited Industrial; <br />2. That because of the uniqueness of the use and the pending <br />rezoning the applicant has filed for a special use permit; <br />3. That the consideration of the special use permit <br />establishes the foundation for future consideration of <br />the building permit application; <br />4. That the Planning Commission is only considering the use <br />of the property pursuant to Section 8~130 of the New <br />5. That the outside display of vintage railroad equipement <br />for public education purposes is not to be considered <br />outside storage; <br />6. That the area is zoned industrial and that the only area <br />therefore under the zoning code requirements that must <br />have concrete curbs is the access drive Up to the first <br />building, no other driving/parking area is required to <br />have curbing; <br />7. That the depot building being a historical structure on <br />display for educational purposes should be located next <br />to the rail line and that normal setbacks would not apply <br />in this case because the structure isa part of the site <br />landscaping; and <br />8. That the rail right-of-way on this subject property to <br />the north of the Historic Eouioment Shelter is 50 feet <br />wide and zoned industrial provides the buffer area between <br />the R-l park property and this site resulting in a 20 <br />foot rear yard setback requirement. <br /> <br />e <br /> <br />BE IT FURTHER RESOLVED, that the application SP-105 is <br />hereby approved subject to the following conditions: <br /> <br />1. That the proposed building meet all applicable zoning <br />and building code requirements; <br />2. That building permit application provide lands~aping to <br />screen/eff-set bulk of metal buildings; <br />
