TO <br />9:25 P.M. <br /> <br />Chairman Williams opened the public hearing. <br /> <br />Judy Linse, 2145 29th Avenue, stated that she opposed proposed application based <br />on her experience with the site in regard to supervision. She stated that the <br />supervisor was sometimes not even inside the facility and that supervisors that <br />she has seen have been too young to properly manage theraci1ity. She noted that <br />her sister was a manager of Arbys and had experienc~ with supervision of young <br />people and stated that her sister felt that the supervisor:s of the same age as <br />the persons they are supervising that peer pressure is too great to have an orderly <br />facility. She commented that on several occasions she has noticed broken glass <br />outs; de the door" persons hang; ng around the door, b; kes 1 ay; ng down ; n front of <br />the door and girls being chased home from the facility. She also said that she had <br />secondhand information that a knife,had been pulled outside of the amusement cent~r <br />and she wondered if the police had been ca-1led and whether or not there w.as a pollce <br />record of this incident. She expressed concern about the numbers of young children <br />in her neighborhood that were younger than four and one-half years old and that if <br />this 'particu1ar hangout would spill into the new park it would cause vandalism <br />problems...in the park and also safety problems for those young children.. She .stated <br />that l,fth.e- operation'~as pro~r1y run as the Circus Amuse:nent Cente,r 1S, WhlCh had <br />two supervisors in the building, one in the food area and one watching the machines <br />and strictly controlled so that there were no kids hanging around and that there <br />was a10t of policing being done that this use would be acceptable. She stated ~hat . <br />the teenagers that she}d, seen in' thi s' facil itY. are at the age where t~ey need, dl r~ctlon <br />and proper supervision and neither are being provided by the owners of this facility. <br />In addition she commented that she is not sure how management could assure the <br />residents that the facility in the future would be propertly supervised when it has <br />been operating for a number of months and nothing has beeD done. She inquired if <br />police reports could be gathered to bring .to the City Council's attention pertaining t <br />to incidents in the park and Rice Creek-:eenter area that could be rela.ted to the amusemen <br />center. She reiterated that she was strongly opposed to the approval of the request <br />for the spetialuse permit. <br /> <br />Richard Ernst 'Senior was present representing the applicant. He stated that he was <br />the owner of the Rice Creek Shopping Center and as the owner had the greatest <br />interest in this particular use. He noted that his son owned and operated the facility <br />and was unable to attend the public hearing. He stated that he felt that the amuse- <br />ment center provided an area for children to meet and be kept busy playing games rather <br />than hanging around interfering with other business operations. He stated that the <br />age of the supervisors were young college students and that when the amusement center <br />was first opened that an elderly couple was hired for supervision. He noted that <br />originally when the amusement center was opened it was a retail sales of ice cream and <br />a sales of game machines which could be used by the public and were sold to resorts <br />and other businesses. He again noted that he had a stronger interest than anyone else <br />because he owned the shopping center and did not want to create problems for other <br />merchants. <br />
