<br />e <br /> <br />e <br /> <br />e <br /> <br />-2 - <br /> <br />Mr. Ernst then reviewed his concerns in regard to the prepared staff resolution <br />and made the following comments: <br /> <br />1. He agreed with statement number one that the property was zoned B-3 general <br />bus i ness ; <br /> <br />2. He agreed that Section 5-240 of the New Brighton zoning code requires a special <br />use for an amusement center; <br /> <br />3. He agreed that Section 8-130 of the New Brighton zoning code lists the standards <br />for the special use permit; <br /> <br />4. He could not understand why the close proximity of a family restaurant which <br />sold wine would interfere with the juveniles which were using the amusement <br />center across the hall, he felt that it did not endanger the public health <br />safety and morals or was detrimental; <br /> <br />5. He stated that the sale of alcoholic heverages adjacent to th.e Amusement Center <br />was not injurious to the use and enjoyment' of other properties and should not <br />affect other merchants within the shopping center; <br /> <br />6. He stated that the shopping center has been consistent of a number of different <br />types of businesses which. do service juvenile patrons; <br /> <br />7. He stated that there is a number of professional people within the shopping <br />center and those professional people on their breaks buy ice cream cones and <br />use the machines; <br /> <br />8. He stated that he was not familiar or did not understand the finding number 8 <br />that the association had petitioned for additional alcoholic sales at the <br />shopping center, he was not familiar with this; <br /> <br />9. He stated that it was not true that Richland had established an amusement <br />center prior to securing a special use permit. <br /> <br />Chai rman Wi 11 i ams i ndi cated that there were a number of electroni c games and that <br />there was a small amount of ice cream sales and that the primary use of the <br />property was recreational and is therefore being used as an amusement center at this <br />time. He further stated that Item No.9 is correct, that the Rich1and is operating <br />an amusement center without a special use permit which is required. <br /> <br />Mr. Ernst continued to review the items on the staff prepared resolution. <br /> <br />10. <br /> <br />'He stated that there has been a number of problems with bi cycles and management <br />is trying to address those problems at this time. <br /> <br />He stated that the entrance doors are right by the bicycle rack and that the <br />proposal will move the bicycle rack farther to the West to avoid this problem in <br />the future. <br /> <br />He felt that the facility was small in size and that one supervisor could <br />adequately supervise the entire area and that there should be no problems. <br /> <br />He stated that the billiard area would be visible from the ice cream counter <br />with mirrored devices. <br /> <br />Mr. Ernst s~ated t~at the hours of operation did not seem to be a problem <br />because thefizza Factory had different hours from other activities in the <br />center and t~at use has not created any problems. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br />
