<br />" <br /> <br />RES Q,L UTI 0 N i~ 0 <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />CQUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />SPECIAL USE PERMIT, SP-108 <br /> <br />WHEREAS, an application for a special use permit entitled <br />SP-108 has been made by Eric Aaron to establish an amusement <br />center at the Rice Creek Center; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for special use permit, SP-10B was <br />filed with the City of New Brighton on September 28, 1982 <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, ~eld a Dublic hearina on October 19, 1982 <br />and November 16, 1982, ~11 persons p;esent at the hearing <br />were given an opportunity to be heard. <br />3. That such application was reviewed by the City Council <br />on November 23, 1982. <br />4. The written comments and analysis of the city staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />N 0 ~' T H :: ? E FOR E BEl T RES 0 L V ED, t hat the New B rig h ton C i t Y <br />Council makes the following Findings of Fact in respect to SP-108. <br /> <br />1. That the property is zoned B-3, General Business; <br />2. That the applicant will have no more than 25 machines at <br />the site and have a supervisor of at least 21 years of <br />age on rluty at all times the business is open; <br />3. That w,ith proper management the establishment will not be <br />injurious to the use and enjoyment of adjacent businesses' <br />and <br />4. That the establishment, maintenance or operation of the <br />special use will not be detrimental to or endanger the <br />public health, safety, morals, comfort of the general <br />public. <br /> <br />BE IT FURTHER RESOLVED, that the application SP-108 is hereb <br />approved subject to the following conditions: <br /> <br />1. That the applicant secure a Council approved amusement <br />center license; <br />2. That there be no more than 25 machines; <br />3. That the applicant work with the owner and other shopping <br />center tenants to discourage/eliminate mall loitering <br />after 8:00 p.m.; <br />4. Thit the bike ratk be relocated at least 20 feet west of <br />the north mall entrance; <br />5. That the applicant control and eliminate any bike parking <br />in conjunction with this business from the mall area; <br />6. That the applicant provide a security guard on Friday and <br />Saturdays when the Amusement Center is open and that the <br />need for such a guard be reviewed by the City Council whe <br />the City Council reviews the renewal of the amusement <br />center i i cense before Apri 1 1, 1983; and <br />7.
