R e.p 0 r t 82 - 2 3 <br />, Page. #4 <br /> <br />.. <br /> <br />,STATUS OF DNR PERMIT APPROVAL <br />On Tuesday, January 18th, a DNR staff person coordinating their permit <br />revi~w told me the last division of DNR to review this application was <br />on .the wildlife section. I was told however that the wildlife review <br />was being completed and that it appeared there would be no significant <br />environmental effect finding. However, I was told that it was highly <br />probable that DNR would deny the permit based on the concern for the <br />precedent setting nature of permitting develooment within a wetland <br />area. DNR expressed a concern for similar projects throughout the <br />metropolitan area. As of this writing (1/21/83) I have been unable <br />to obtain further information from DNR. <br /> <br />The DNR situation was discussed with our City Attorney and it was his <br />opinion that DNR's concern was regional in nature and perhaps something <br />not of local concern. The City Attorney suggested that any approval <br />by the City should be contingent upon approval by DNR. The City <br />Attorney further suggested that if the Council shared the concern of <br />DNR that a letter from the Council to DNR expressing this concern may <br />be appropriate. <br /> <br />SUMMARY AND CONCLUSIONS <br />The application consis~of a special use permit, SP-109 a.nd a building <br />permit, LP-137. It appears that the application for special use permit <br />can be considered under Section 10-040 (b) (Floodway Ordinance). <br />Further, the application does not appear to have a detrimental affect <br />on development of surrounding property or that it would be injurious <br />to the public health, safety or general welfare. Finally, with some <br />contingencies, the application meets the requirements of Section 4-600 <br />regarding height exceptions. <br />
