<br />Council Meeting Minutes <br />January 26, 1988 <br /> <br /> <br />III 5 Ayes - 0 Nayes, Motion Carried <br /> <br />Scott Goldsmith, attorney for 0 & T Trucking, asked where the city <br />is in the process of the redevelopment, noting only the plat is on <br />the agenda; Benke indicated the condemnation request was postponed <br />because a Letter of Credit has not been received. <br /> <br />Goldsmith asked if the <br />Benke stated that was <br />meetings over the last <br />phases, and indicated <br />him and go through the <br /> <br />redevelopment portion had taken place; <br />a part of discussion at several different <br />few months and the project will proceed by <br />staff and the developer will sit down with <br />detailed plans. <br /> <br />Goldsmith expressed concern that council will proceed without con- <br />sidering what the consequences of Phase II and Phase III will be <br />to the community; Benke indicated that that was a part of the dis- <br />cussion at the last meeting. <br /> <br />Goldsmith asked at what point 0 & T Trucking can have input in a <br />way that it does not create an unfair or discriminatory hardship <br />for 0 & T Trucking and does not create unfair and discriminatory <br />, <br />liabilities for the city. <br /> <br />I <br /> <br />Benke suggested he meet with Locke and the developer at the <br />earliest opportunity to go through the plans. <br /> <br />In response to Goldsmith's question, Benke stated the city had en- <br />tered into an agreement as if there would be consummation of the <br />total package and that there will be a final plat approval prior <br />to which time all issues will be considered. <br /> <br />LeFevere stated if the preliminary plat is approved on the assump- <br />tion that the development agreement will go forward and, if for <br />any reason the plat is inappropriate, council may wish to add an <br />additional condition that satisfactory concept progress is being <br />made with respect to compliance with the develcpment agreement at <br />that time. <br /> <br />Locke advised that all of this property will pass through the <br />city's ownership before it goes to the developer and the city <br />would need to have the development agreement in complete confor- <br />mance before any of the property is transferred. Locke indicated <br />he will speak with 0 & T Trucking and their representatives about <br />their concerns immediately, but the process will be the standard <br />platting process. <br /> <br />I <br /> <br />Goldsmith felt the process seems to be taking shape well before <br />that opportunity presents itself; it appears, in terms of redevel- <br />opment as a whole, there seems to be a very conscientious effort <br />to take what would be a present use consistent with the proposed <br />redevelopment but exclude 0 & T Trucking; has presented possibili- <br />ties on how the property might be improved and included with the <br />redevelopment without the kind of damages that might result to 0 & <br /> <br />Page 10 <br />
