<br />Council Meeting Minutes <br />January 26, 1988 <br /> <br />I <br /> <br />Briggs asked who would make the determination; Benke indicated <br />council will do so on final approval, assuming the drainage way <br />already includes the water that will be coming off this plat site. <br /> <br />Proper responded the city's storm water management plan shows sev- <br />eral other ponds are needed for this area; some of the future <br />ponds on the property are shown to overflow to this pond which ul- <br />timately is to go to the east end to Pike Lake, Long Lake, etc. <br /> <br />In response to Benke's question, Proper indicated of the ponds in <br />the plan, this is the biggest in the area and the developer will <br />have to increase sizes of the other ponds for the overall drainage <br />plan to be met. <br /> <br />Briggs stated the temporary ponds, which are not in the drainage <br />plan, will run water off the site very slowly; Harstad Companies <br />will later build new ponds to accommodate the entire site; and in- <br />dicated Harstad Companies will also try to mitigate interim prob- <br />lems across 12th Avenue N.W. <br /> <br />Benke stated the addition of ponds and control on this plat site <br />will reduce water problems through Vacca's area. <br /> <br />I <br /> <br />Gunderman believes staff has done their job, and asked what can be <br />done to facilitate the process. <br /> <br />Williams stated hopefully Hickock will come up with some ideas. <br /> <br />Briggs assured councilmembers that Harstad Companies will conform <br />to their own grading plan. <br /> <br />Sinda stated there are means by which the city can resolve the <br />problems if a waterway is blocked; however, if the blockage is on <br />private property, the city should not get involved, just as it <br />does not get involved in the blockage of a private street. Sinda <br />continued that if we become involved with this problem, Vacca may <br />not be happy with the solution; and pointed out that if a private <br />issue goes to court, negotiations are more apt to take place be- <br />fore going to court. <br /> <br />Benke agreed 100%, but asked if this particular problem is a pub- <br />lic or a private one and asked that that be resolved before the <br />next meeting. <br /> <br />4 Ayes - 1 Naye (Gunderman), Motion Carried <br /> <br />I <br /> <br />Mattila reviewed staff report regarding Phase I of the proposed <br />project. <br /> <br />James Senden, developer was not present; Leonard Venoth, partner, <br />had nothing to add to the staff report. <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING AND <br />ADOPT A RESOLUTION APPROVING PL-168. <br /> <br />Page 9 <br /> <br />PL-168 <br />James Senden <br />Report 88-33 <br />Resolution 88-13 <br />
