<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />January 12, 1988 <br /> <br />If council holds the first reading of the ordinance, Benke noted <br />the current issue may be resolved by the second reading and publi- <br />cation of that ordinance declaring a moratorium. <br /> <br />LeFevere pointed out that both the resolution and the ordinance <br />prohibit the granting of various kinds of permits that may be ne- <br />cessary for uses involving outside storage, they also prevent the <br />expansion of existing uses involving outside storage. Those may <br />include uses which do not require a permit approval by council. <br /> <br />Benke also asked for input from the Economic Development Commis- <br />sion as to the impacts on those items and various sites along the <br />Old Highway 8 corridor; suggests holding a first reading tonight <br />and ask staff to expedite the review. <br /> <br />Motion by Williams, seconded by Gunderman, to WAIVE THE READING <br />AND HOLD THE FIRST READING OF AN INTERIM ORDINANCE RESTRICTING THE <br />DEVELOPMENT OR EXPANSION OF USES INVOLVING EXTERIOR STORAGE. <br /> <br />Brandt stated she is not comfortable with the proposed ordinance <br />and asked that it be amended to insert Boerner Building System's <br />name; Benke stated it can be included in the second reading. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Locke reviewed staff report concerning a quick take resolution on <br />properties in Phase I of Brighton Corporate Park; however, because <br />the developer has not yet completed all of the required action to <br />date, staff is suggesting action not be taken on the resolution <br />this evening. Staff has been talking to residents and property <br />owners in the Phase I area and it is possible we will not need to <br />use any condemnation to acquire the property; however, we may <br />need, at some point, to adopt such a resolution to provide staff <br />with an outside time limit so it is certain we can acquire the <br />property on a timely basis for the developer. <br /> <br />Benke asked if there is any value to including conditions on the <br />other conditions such that, if we need to, we can proceed; Locke <br />indicated it could be done but, from a practical standpoint, was <br />not sure it would make much difference whether we waited to take <br />the action on January 26th or if it were approved tonight contin- <br />gent on the pieces being completed. Locke indicated the key date <br />is when we actually file the petition with the court and then no- <br />tify all of the property owners of the condemnation and, in any <br />case, that would not happen until right after January 26, 1988. <br /> <br />In response to Benkels question, Locke indicated staff has advised <br />the property owners that staff would have the quick take authority <br />if it is needed. <br /> <br />James Senden, developer, stated he is working as quickly as pos- <br />sible; and does not see deferral of this action until the next <br />meeting will affect their project in any way. <br /> <br />Page 14 <br /> <br />Brighton Corporate <br />Park - Phase I <br />Quick Take <br />Authority <br />Report 88-18 <br />
