Corporation <br />2550 County Road H-2 <br />New Brighton, Minnesota <br />Dear Mr. Ernst: <br />I am writing this letter as a result of your inquiry last wee1; <br />regarding our leased property for a 7-Eleven :tore at.Silver Lake <br />Road aid County Road E. New Brighton. Fleaz;e be advised that <br />this location was submitted and approved based upon a site plan <br />containing four driveways, two fronting to County Road E and two <br />fronting to Silver Lake Road. It is my understanding that these <br />Streets are County Roads and these driveways have been approved <br />?;- by Ramsey County. <br />I am advised there is now some thought to closing one of the <br />driveways fronting Silver Lake Road. Such a closing would not <br />be in Southland's best interest. It would in fact impose a <br />hardship upon the internal traffic maneuvering of the site <br />thereby rendering the site inoperative for a 7-Eleven Food, Store. <br />Therefore, Southland would ba required to exercise the right <br />provided in the Lease Agreement, Paragraph 17, &KIN ANT Mi'.IN <br />as follows: <br />"If all of the le?asmd primissas are taken tinder the power <br />of emizient domain or conveyed under the threat of con- <br />demnation proceeding,, or if only a part of such premises <br />art t 6-itaken or conveyed ane, 7 ESSI? shall determine that <br />the remainder is inadequate or unsatisfactory for its <br />purposes, which determination shall not be arbitrarily <br />or capriciously made, then in either event, this lease <br />shall terminate effective as of the date" UbSrE is required <br />to give up the right to occupy or use any part of tale <br />leased premises or common areas.
