PUBLIC HEARING <br />VN-114 <br />January 22, 1974 - 8:15 PM <br />PETITIONER: Road Machinery and Supplies, Inc. <br />LOCATION: Generally east of Old Hwy. 8 and south of Hwy. 96 <br />NUMBER OF PROPERTY OWNERS WITHIN 200 FEET OF LOCATIO14 $ <br />PETITIONER'S REQUEST: Variance from Section-10-110(h) of the <br />Zoning Code to allow parking in the front <br />yard in an industrial district as shown on <br />attached plan. <br />ORDINANCE REQUIREMENTS: Section 10-110(h) - <br />"In an industrial district, the front yard <br />and/or any side yard bordering upon a <br />street shall be landscaped and shall not <br />be used for parking." <br />PLANNING DISCUSSION: <br />At the time of construction of the Road Machinery building in 1972, <br />the Building Inspector noticed that the petitioner had extended his <br />blacktopped parking area 18' 6" into the front yard. This was a <br />deviation from the approved plan and the Building Inspector informed <br />the petitioner that he would either have to remove this blacktopping <br />or apply for the variance. <br />The petitioner has s nce occuii?d the building and one year after the <br />Building Inspector's notice has applied for the variance. <br />In addition to the above deviation from the approved plan, the <br />petitioner moved his fence from a point even with the front of the <br />building to .? point even ;-7ith the back of the office portion ?t L-ho <br />structure. Tne result has baen to leave parking spaces outsiur <br />fence, some of these spaces extending into the front yard. <br />Planning Commission Consideration (12-18-73): <br />The Vice-Chairman read the planning discussion. <br />Warren,. Wilson, manager of Road Machinery, appeared representing the <br />applicant. He explained that at the time of construction he was new <br />in the area and that he decided to move the gate back and extend the <br />parking in order to provide more parking with easier access to the <br />office area. He stated that he did not know this would not be <br />permitted. <br />Daniels asked how the three conditions for a variance were met in <br />this case.
