LOCATION: Southeast quadrant Hwy.'96 and'Old Hwy. 8 APPLICANT'S REQUEST: Variance from Sections 10-120 (g) and 12-030 .(c) to permit parking in a street side yard and to have the front yard substantially unland- scaped by leaving the present concrete and asphalt pad ZONING: I-1 DISCUSSION: The property in question presently contains an abandoned Standard Oil Station.. The applicant intends to remodel that structure for use as an office for their con- struction company. The building will not be expanded. The structure and premises meet Zoning Code requirements with the exception of the concrete pad in front of the building. The variance is being requested because the applicant wishes to leave the concrete pad in place and also wishes to park approximately six vehicles to the north of the .building in the sideyard. Section 10-120 (g) states that in any industrial district the, front and/or sideyard bordering on a street shall be landscaped and shall not be used for parking Section 12-030 (c) essentially repeats this requirement. It is the applicant's intention that the parking in the street sideyard be temporary until he can fill the back area of the property to use for parking. At present, the land slopes off rapidly behind the service station. The temporary parking could continue, however, for up to three years as the filling-..is proposed to occur in three stages. A landfill permit will be required. The property was abandoned for more than six months as defined in Section 3-70. It is the City Attorney's opin- ion that once a non-conforming use has been abandoned, the Zoning Code is applied to it as if it ware a new-build ing. Therefore, on this basis a variance would have to be granted to use the property as the applicant wishes.,
