Public Hearing <br />VN-i20 <br />June 11, 1974 8.10 p.m. <br />APPLICANT': LPW,,Inc. <br />LOCATION: Southeast quadrant Hwy.'96 and'Old Hwy. 8 <br />APPLICANT'S REQUEST: Variance from Sections 10-120 (g) <br />and 12-030 .(c) to permit parking in a street side <br />yard and to have the front yard substantially unland- <br />scaped by leaving the present concrete and asphalt <br />pad <br />ZONING: I-1 <br />DISCUSSION: The property in question presently contains an <br />abandoned Standard Oil Station.. The applicant intends to <br />remodel that structure for use as an office for their con- <br />struction company. The building will not be expanded. <br />The structure and premises meet Zoning Code requirements <br />with the exception of the concrete pad in front of the <br />building. <br />The variance is being requested because the applicant <br />wishes to leave the concrete pad in place and also wishes <br />to park approximately six vehicles to the north of the <br />.building in the sideyard. <br />Section 10-120 (g) states that in any industrial district <br />the, front and/or sideyard bordering on a street shall be <br />landscaped and shall not be used for parking Section <br />12-030 (c) essentially repeats this requirement. <br />It is the applicant's intention that the parking in the <br />street sideyard be temporary until he can fill the back <br />area of the property to use for parking. At present, the <br />land slopes off rapidly behind the service station. The <br />temporary parking could continue, however, for up to three <br />years as the filling-..is proposed to occur in three stages. <br />A landfill permit will be required. <br />The property was abandoned for more than six months as <br />defined in Section 3-70. It is the City Attorney's opin- <br />ion that once a non-conforming use has been abandoned, <br />the Zoning Code is applied to it as if it ware a new-build <br />ing. Therefore, on this basis a variance would have to <br />be granted to use the property as the applicant wishes.,
