1694 - 23rd Avenue 1Vorthwest <br />New Brighton, Minnesota 55112 <br />July 11, 1974 <br />Members of the Planning Commission <br />City of New Brighten ''- <br />New Brighton,' Minnesota 55112 <br />Gentlemen: <br />I wish to buile3 a six-fogt cedar "board on board" privacy fence in <br />my back yard as outlined in the attached diagram, and therefore Z <br />am formally requesting a variance of the .zoning code (Section 13- <br />050) and the building code (Section 440) which would restrict my <br />fence to 312 feet high along the common property line to-the west <br />and to 4Z feet high along the 17th Street (north) side. I believe <br />that my request is justified since I meet the criteria for variance <br />as follows. <br />a) _Undue hardsh~s; my house is on a corner lot and there- <br />fore the north side of my back yard is ex~sed. to 17th <br />Street IeT,Wo, a very busy thoroughfares For this ,reason, <br />my wife and I cannot allow our 2~ year old daughter and <br />our black I,aborador to play in the yard unattendedo. This <br />puts a considerable strain on my wife°s daily freedom and <br />is certainly inhibiting to the child. It also forces us <br />to confine the dog in a small steel cage behind our garage. <br />(He once got free for but a fe w moments and was struck by <br />a ca~eo nearly killing ha.m) <br />It should also be noted that a fence only 4Z feet in <br />height cannot be guaranteed to restrain my dog (I have. <br />checked with Armstrong Kennels regarding this), or keep <br />neighborhood dogs from entering my yard, There are cur- <br />rentl~ many d®gs, both large and small, which are allow- <br />ed to freely roam the neighborhood and they represent a <br />threat to the health and safety of my child (and d®g)o <br />Lastly, my family is presently being denied the right of <br />privacy and safety from theft or vandalismo Any gather- <br />ing is limited to the inside of the house since no one _ <br />prefers to sit in the yard and be examined by each car <br />or person passing by® Lt~e also cannot leave the baby°s <br />toys or any gardening equipanent outside for fear of thefty <br />We are even forced to lock the dog's cage each night. <br />
