<br />July 11, 1974 <br />Members of the <br />' Page 2 <br />Planning Commission <br />b) Unique circumstances: the fact that my back yard abuts <br />my neighbor's side yard should probably be considered <br />a unique circumstance..:In my -reading of the building <br />code..and the zoning code in regard to fences, it appears <br />that the above mentioned situation was not given due <br />ccnsideration. As a matter of fact, only a somewhat <br />liberal interpretation of the codes will allow me to <br />build any fence at all in what I call my back yard. <br />c) Applying to the propertya the property inside of the <br />proposed fence line is approximately 3 or 4 feet higher <br />than the adjoining lots. This creates~ree unique prob- <br />lems. <br />1) Even a 4~-foot high fence placed inside the proposed <br />fence line would be on top of the rise and effective- <br />ly higher than a ~-foot fence as diagramed. <br />2) A fence of any height along a line south of that in <br />the diagra~~a e~ould rise and fall again 3 or 4 feet <br />in three different p~,aces. This would certainly be <br />unsightly to the neighbors across 17th Street, N.W., <br />and would also be undes~.rable to my wife and I. <br />.Actually, the line as drawn represents the first <br />place where the fca~ce caould appear level to those <br />neighbors across the street. <br />3) .Also, assuming the fence was to be built a3.ong the <br />lines as shown, another problem becomes immediately <br />apparento Due to the height of the center of the <br />-lot, a 4•~~foot high fence would provide no privacy. <br />A5 a matter of fact, a 6®foot high fence will only <br />give us about 2 feet ~f privacy. <br />In addition to .all of the above, I would like to point out that this <br />fence would not be a hinderance to motorists on either 17th Street, <br />N,W. or 23rd Avenue, N.W., because there will stillbe approximately <br />25 to 30 feet of lawn between the northern boundary of the fence and <br />the curb of 17th Street, N.W, For this reason, I cannot also see <br />where I am blocking any neighbor®s v~.ew ®f the rest of-the neighbor- <br />hood, <br />
