I <br />- 2 - <br />1. Mr. harstad apply for a variance by July 23; <br />2. That the Attorney review the lease and <br />mortgage on the property to determine what <br />effect the closing of the road would have on <br />the above; <br />3. That a traffic engineer study the impact of <br />the leaving of the westerly driveway on <br />County Road E as it presently exists, such <br />traffic engineer to be commissioned by <br />Mr. Harstad; <br />4. That the City Attorney review the history of <br />the transactions on the property including <br />its status when it was sold to the developer <br />who constructed the 7-Eleven complex and the <br />transaction between that original developer <br />and Mr. Harstad. <br />5 ayes - 0 nayes - carried <br />(July 23, 1974) <br />Motion by Eagon, seconded by Rebelein to receive report from <br />City Attorney relative to 7-Eleven Service Center, County Road E and <br />Silver Lake Road. <br />5 ayes - 0 nayes - carried <br />Motion by Eagon, seconded by Anderson, to defer action relative <br />to litigation until a hearing is held relative to the petition <br />variance on the property. <br />5 ayes - 0 nayes - carried <br />Discussion: <br />Regarding the conditions placed on the July 9, 1974 motion <br />of deferral: <br />1. Mr. Harstad has applied for a variance. <br />2. The Attorney has reviewed the lease and the mortgage. <br />3. To our knowledge, no traffic engineer has studied the <br />impact of leaving the westerly driveway as it presently <br />exists.
