PUBLIC HEARING
VN-138
February 11, 1975 - 8:05 P.M.
Request: Variance from Sections 10-120(8) and 12-030-(c) to allow
reinforced concrete driveway and.truck maneuvering.areas
to be left in place. \
Applicant: Lange Brothers Realty
Location: 1451 lst AvenVe NW
Discussion.
On November 14, 1972 the City Council authorized issuance of a
building permit to Lange Brothers for a warehouse building at
the above location. This permit was based on a site plan which has
been sent to the Council members.
When the property was developed, therewere a number of changes
from the original site plan. Among those changes, was the removal of
the driveway in front of the building. When this.change was made,,
certain concrete areas were left in front of the building on each
s de.of the two existing driveways. Under the terms"
of, the Zoning Code, these are front yard parking areas and are
violations of'Section 10-120 (g) and 12-030 (c)
The applicant was notified that he had to remove the parking
areas. When he failed to do so he was prosecuted in Municipal
Court. The Court convicted the applicant and gave him until
August 1, 1975 to-either complete the plan as originally approved
or to conform to any amendments to*it that the City Council might
approve
The applicant is requesting a variance to allow the front yard
parking areas to remain in place.
If the request is granted, parking will obviously continue
in the front yard. We are, in fact, concerned that even if the
parking areas themselves are removed that people will continue
to park in the driveways. At a minimum, the applicant should be,,
required to post no parking signs around the driveways and other
concrete areas in the front yard and paint yellow all the curbing
in`that area. The applicant should be required to notify his
