Council Proceedings City of New Brighton Sept. 9, 1975 Attorney stated hearing was properly called Mr. Richard Henke was present Motion by Rebelein, seconded by Eagon to close hearing 5 ayes - 0 nayes - carried Motion by Bromander, seconded by Anderson to approve VN-147 2 ayes - 3 nayes (Fisher, Rebelein, Eagon} motion failed Councilman Fisher stated for the record he was opposed to the ,variance for the following reasons° 1. Area ratio is ultimate land use control which applies and ultimately limits the development of all property in Ne~r~ Brighton; 2. The area ratio requirement is completely non--discriminatory in its application allowing any and all .properties to be developed in proportion to their size; 3. It is difificult to identify any circumstances of the property which would cause the area ratio to .work hardship. None have been identified in this case. 4. Hardships demonstrated have been relevant to the applicant only. 5. Under these circumstances, granting of the variance would violate the constitutional guarantee of equal protection of the law, .Attorney stated hearing was properly called Robert Londin, contractor for the proposed development was present to answer questions along with Richard Tyson owner. A question was raised as to where on the property would be truck parking. Tt was noted that parking would be to the rear of the buildings. It was asked how many employees would be working at the company. Petitioner responded there would be 14 office employees to park in front of the building, 50 truck drivers that work at both New Brighton and Arden Hills facilities. He further noted that the trash container would not be located with in the building and that additional parking would be made available at the rear of the property.
