<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />September 8, 1987 <br /> <br />Public Hearings, continued <br /> <br />Brandt reviewed Financial Policy Advisory Board's discussion of <br />appropriateness and policy with regard to when an assessment would <br />be made and collected; and one of the situations they had to <br />imagine was when a diminuitive amount is to be collected in com- <br />parison to the amount of staff time, printing costs, attorney's <br />fees, and everything else that goes into noticing the hearing that <br />at some point it is not sensible to do the assessment. <br /> <br />Benke stated staff would need to take those factors into consider- <br />ation during negotiation. <br /> <br />Ed Rybak, 303 Tenth Street N.E. stated he understood the city's <br />policy to install water connections on vacant lots when street <br />work was being done, but did not believe he should be assessed be- <br />cause he has no intent to sell his extra lot, nor was he even in- <br />formed that the work would be done. <br /> <br />Proper indicated the assessment could be removed and the cost col- <br />lected in the future as a hook-up fee when the land is built upon. <br /> <br />Blomquist asked if that hook-up charge would be recorded on the <br />property deed in any fashion; Proper stated a building file would <br />be created and a notice would be placed therein, as well as in the <br />pending special assessments file. <br /> <br />Blomquist felt the potential purchaser would have to pay about <br />$5,000 for the hook up, in addition to the cost of the land. <br /> <br />Brandt asked if it could be filed against the property; LeFevere <br />stated it could be, but the smart buyer would check on it. <br /> <br />Benke noted this case could be pursued as a separate issue. <br /> <br />In response to Williams's question regarding procedure, Proper re- <br />ported as a routine the city did not notify each owner and further <br />explained this was something unique or it would have been in the <br />public hearing notice. <br /> <br />Dalzen asked, if the assessment is not paid interest-free within <br />thirty days, if the assessment could be paid off before twelve <br />years; Proper indicated it could be paid off at any time, and <br />noted the best time would be in October of any year. <br /> <br />In response to Dalzen's question, Proper indicated the end of the <br />performance period would be two years from today's date because <br />council approved final payment on the contract this evening. <br />Proper further stated the project will be reviewed after the <br />streets are swept in the spring of 1988 and 1989. <br /> <br />Benke stated if problems are discovered, they will be on a city <br />council meeting agenda. <br /> <br />Page 6 <br />
