_2_
enclosed revised survey which shows that the eastern parcel has been
widened in the area aligning the existing house. Scaled measure-
ments indicate that the width of the revised eastern parcel, in the
area aligning the existing house, is 75-85 feet, so there should be
ample room to construct a house in this area.
In their action of November 23, the Council also directed
that the variance resolution be amended by deleting 2.a. in the first
BE IT FURTHER RESOLVED. The .revised variance resolution shows this
deletion. We would note that No. 2 of the first BE IT FURTHER
RESOLVED has been further amended by deleting 2.b. and inserting
that the unique circumstance is the unusual shape and size of the
parcel. This change has been made because it appears questionable
to us whether there is a uniqueness in a property that can only
be subdivided by means of a variance. A variance would be needed
to subdivide all substandard lots in the City. If this change is
not in keeping with the Council's intent, the resolution will be
revised.
The revised variance resolution also indicates that a further
condition has been added to the second BE IT FURTHER RESOLVED con-
cerning the alignment of the house to be constructed on the eastern
parcel. This condition defines a 100 foot depth area within which
the house would be required to be located. This condition was
added based on our understanding of the Council's concern for the
general alignment of houses. If it is not the Council's intent
to regulate the alignment of houses in this manner, this condition
cou]_d be deleted.
