The applicant ,has further <br />indicated that it is difficult to apply platting requ a tions:`to <br />this area which-Naas platted in part at various times.: The <br />applicant has`a.lso noted that he variance is requested because <br />of the unique circumstances:.applying to the property, such as <br />the unusual topography,`the location:: of existing structures <br />and land parcels, the parcel's shape, and the parcel's size. Last y, <br />the applicant has indicated-that the variance would not conflfct <br />with the City's Comprehensive Plan or its zoning code, that the <br />gra~iting of the variance would not be detrimental or injurious <br />to property or'improvements in the neighborhood than. the variance <br />would not impair an adequate supply of light or air to adjacent <br />proper y, substantially increase traffic or congestion, or increase <br />the danger of fire, or .endanger .the public-safety. <br />Zn regard to h's request, ww would comment that she stated intent.. <br />o~ the subdivision regulations is to promote and protect the public <br />health, safety-.and .general welfare. It would also appear that the <br />implied :intent. of the subdi~~~s:~.on regulations promotes the orderly. <br />and uniform subdivision of proper~cy. In terms of this request, <br />we see potential problems regarding lot lines and.pro~erty <br />ownership, annoying conditions resulting srom lot line confusion; <br />-and from. the construction of a house in an area adjacent to the <br />back yards of abutting-.lots, property values of adjacent lets <br />m~.y be diminished by construction that may..impair lake views, <br />Zessen privacy and perhaps,-make rear yards less desirable iz~ <br />terms of usable.-open space. There may a7 so bE a question of <br />'whether"the public safety is being-promotes ?~y the subdivision. <br />The new home constructed would beset ~.vel1 back rrom the street <br />in a.n aces. of lower elevation surrounded by adjacent homFS-and <br />trees which may make it Jiff icult for police and fire to locate <br />the property in an emergency. It appears there may also be <br />nadequatF area for fire trucks to turn around if they must eneter <br />..far into bhe property. Access from this parcel into bong Lake <br />Road may also raise a safety concern. Specifically,-the construction, <br />of an addit-ion~l driveway would. leave three driveways. in an area <br />.of approximately 40 feet, near the-end of the curve on Long Lake <br />Road. This may create problems for northboundtraffic on Long <br />Lake Road and for traffic entering and exiting the subject parcel. <br />The concern-.for ..traffic may, however, be minimal as one additional <br />single family`home`is not likely to create an excessive number of <br />da: i ly trips . <br />
