- ~ ..
VN-:166 ~ ~2_
t
'of undue hardship and unique circumst~nees must be present to
justify the variance. ~
'The`Zoning Code regulates land use uniformally in spPCifyng
`minimum lot widths and areas. In this case, it is obvious
tha all Come requirements could be satisfied if ;this parcel
were platted into only 3 lots. As the parcel can be platted
to meet all requirements; there may be ~-question of whether the.
hardship is related to he hnd, apart from economic concerns
or desires: The uniqueness of the ,property may also be questioned
as there are no existing structures,;marsh areas., extreme topo-
graphical differences or irregular property lines.: As noted,
the applicant has indicated that the property is unique in-that
it has access only off of Sth St. This accessmay be a ba lid
concern.. In the discussion for PL-108 it is noted that the
four.-lots created would be extremely deep and. that this may .not
be the most efficient use of land. It is further indicated- in
that discussion that while acquiring additional land or securing-
access-from 11th Ave. may be preferable `and may permit
more efficient land use,. those are factors: over which the applicant
may have little control. F
It should also be noted that both the-Board of .Planning and
the Housing and Redevelopment Authority have been discussing the
inclusion in their plans of a policy calling for a new single
family residence zoning district that would require smaller lot
areas and widths than the present ordinance... The intent is that
this district would be used in the older area of town where typical
lot sizes are smaller than the present ordinance-requirement in order
to remove the need for variances in order to build on these lots.
Neither group has defined a specific area where this new zoning.
district should apply. There is no implication in this discussion
that the property in question would be proposed to be within this
new zoning district.
Additional comments regarding this request may be found in the
discussion for PL-108...
l ;.
