Falcon Oil" -2- <br />Mr. Ahlberg replied that the station had been self-service <br />since June, 1975. <br />Mr. Snow stated that for 20 months in a row Falcon Oil Co <br />has been running at a deficit. He stated that, in effect, this <br />station is the bread winner and for that reason, it is extremely <br />important to Falcon Oil. <br />Mr. Ahlberg also noted that this station is extremely critical <br />for Falcon Oil in that it has carried the load for several months. <br />Mr. Snow reviewed the standards or warrants for a variance and <br />noted that they do have a hardship in their present location of <br />the building which prevents them at this time from moving their <br />pump islands. <br />Mr. Snow reviewed a Stat Supreme Court decision regarding <br />variances. He noted that in their decision, in the Merrian Park <br />case that, the amount of variance granted was not so important. <br />He further noted that the Court didnot say that there had to be only <br />topographic unique circumstances to justify the variance. <br />Hr further noted that the Court, in effect, was saying that city <br />Councils could look at all aspects of the case including economic <br />hardship. Mr. Snow stated that Falcon Oil has a unique circumstance <br />in the location of the building and further, that they have a great <br />economic hardship also. Mr. Snow .further noted that the Council had <br />asked Falcon Oil to consider and investigate the possibility of <br />moving the pump islands. Mr. Snow stated that they contacted Police <br />Chief Holmes in order to see how far the islands could be moved. <br />He stated that Police Chief Holmes felt they should-maintain at <br />least a 22 foot driving lane. Mr. Snow noted that they have contacted <br />a company to obtain a bid-for moving the islands and that to move <br />the islands approximately 7 or 8 feet would cost in excess of <br />$10,000. He further noted that to move the islands only 2 - 4 feet <br />would cost approximately $9,000 or actually just slightly less than <br />to move it a greater distance. <br />Commissioner Doyle asked if the $14,000 price fo'r the canopy <br />included installation. <br />Mr. Snow stated that the $14,000 price did,include installation <br />which was to be approximately $1,500-, Mr. Snow noted that the <br />building location has created a great hardship in that it would be <br />an astronomical expense to move the building.
