VN-169, NC-15, LP-39, Falcon 'oil Company <br />The City Planner reviewed his comments noting that the <br />.variance was needed because the canopy would project over the <br />required setback area. The City Planner also. noted that there <br />were existing Type IV non-conformities on the property. <br />Wickland asked if the canopy were a sign. <br />The City Planner stated that this canopy was not considered <br />a sign by the Administration. <br />Partyka asked what a canopy was considered as by the Zoning <br />Code. <br />The City Planner responded that it was the Administration's <br />interpretation that the canopy is a structure which requires a <br />building permit approved by the City Council. <br />Partyka noted that there are some encroachments permitted <br />by the Zoning Code. <br />Mr. Rick Ahlberg, representing Falcon Oil, was present to <br />answer questions. Mr.. Ahlberg stated that they do want to construct a <br />canopy but are limited by the location of their pump islands. <br />Mr. Ahlberg stated that Falcon has wanted to put up the canopy <br />since they went to self-service.; Mr. Ahlberg stated they have <br />erected canopies at two of their other locations but that because <br />of economics have only recently been able to afford the canopy for <br />this location. Mr. Ahlberg stated that in no way would the canopy <br />obstruct vision at the intersection as it would be 13'6" above the <br />ground. <br />Brown asked if Falcon oil considered, this station a long term <br />investment and if they were here to stay. <br />Mr. Ahlberg stated absolutely that Falcon Oil had every <br />intention to stay. <br />Brown `asked if the decision to -construct the canopy was <br />influenced by Super America constructinga canopy across the street. <br />Mr. Ahlberg stated that Falcon Oil had decided prior to Super <br />America to erect the canopy.
