Anderson noted that he did not feel that the canopy would <br />create an obstruction along Silver Lake Road, Anderson noted <br />that there is already a canopy across the street. <br />Brown noted that the Planning Commission should consider this <br />case on its own merits. Brown further noted.that Super America's <br />canopy was erected without a need for a variance. <br />Motion by Harty, seconed by Wickland, to recommend approval <br />of VN-169 based on the conditions that the unique circumstances <br />applying to the property is that the station is self-service and <br />it would be beneficial to the community to have protection for <br />customers and further that it would be an undue hardship for the <br />station to move their pumps. <br />Anderson noted that if the station and pumps were moved to the <br />east, it would piac.-e it closer to an R-1 district, which would <br />:got be beneficial. <br />Wickland stated that he felt the 15' variance was a large <br />Encroachment. <br />Harty stated that he felt this was a matter of interpretation <br />it that this was considered a structure and it is floating. <br />Harty further indicated that he did not feel that the canopy would <br />have a great visual impact on the area. <br />Councilman Hardt stated that both the unique circumstances and <br />u?due hardship must apply to the property .;:itself.. <br />Councilman Hardt noted that all of the circumstances were create <br />b• the applicant. <br />Mr. Ahlberg noted that the station was built prior to the <br />ac;rent of self-service operations. <br />Harty stated that he felt the `Planning Commission had to look <br />at the situation as it exists right now. <br />Wickland restated-that he felt this was a rather significant <br />emc-oachment andAt might be best to send this matter on to the <br />Council without a recommendation. <br />Vote on motion - 2 ayes - 4 naves (Wickland,` Partyka, Bohling, <br />Anderson) - motion failed
