Motion by Wickland, seconded by Bohling, to recommend denial <br />of VN-169 because the 15' encroachment is very significant and <br />there are many other stations that may make the same request. <br />Further, it may be best to treat this matter in some other fashion <br />rather than through a variance request. <br />Harty stated that it seems by this motion that if the applicant <br />wants a canopy for competitive purposes, he will have to move his <br />pump islands and station. <br />Wickland said that at this point in time that is correct. <br />Wickland said that they are recommending to the Council to direct <br />somebody to study this problem with respect to all gas stations <br />in the City of New Brighton. Wickland stated that this was not an <br />uncommon problem. <br />Vote on motion - 5 ayes - 1 naye (Harty) - motion carried <br />Bohling asked if the Administration's interpretation had ever <br />been applied before. <br />The City Planner responded that the most recent example <br />was the canopy for Super America located across the street. <br />Partyka suggested that perhaps more investigation should be <br />done regarding whether this:is really a structure, <br />NC-15 Falcon Oil Company <br />Brown asked Mr. Ahlberg if they would be willing to provide <br />additional landscaping in the area including the crushed rock; <br />Motion by Wickland, seconded by Brown, to recommend approval <br />of NC-15 because by, providing the concrete curbing and closing the <br />southerly driveway on Silver Lake Road, the applicant is reducing <br />both the total number and the extent of the Type IV non-conformities, <br />and, further, it is recommended that the approval be conditioned <br />on the applicant providing shrubbery in the crushed rock area in <br />the southwest corner of the site. It is noted that this <br />recommendation it provided conditioned on the Council' approving <br />VN-169 and LP-39. <br />6 ayes - 0 nayes carried
