Undue hardship <br />2. Unique circumstances <br />3. Applying to property <br />Further, a variance is not justified unless all three elements <br />are present in the case. <br />Facts: <br />1. The Valley View Addition plat was approved by the <br />City Council in 1970. <br />2. The subject parcel and the lot to the north, Lot 4, <br />are at present undeveloped. <br />3. There is a creek/drainage ditch that flows across the <br />rear portion of this lot. <br />4. The applicant is requesting a variance of ten (10) feet <br />on the front yard setback so that the setback would be <br />20 feet rather than the required 30 feet. <br />5. The lot slopes considerably from the front to the rear. <br />
