Report No. 78-135 <br />June 7, 1978 <br />ew <br />REPORT TO THE CITY COUNCIL <br />1'IghtOn Application for Variance, VN-184 <br />June 13, 1978, 7:45 <br />Purpose <br />To consider an application for a variance to permit construction <br />of a home having a basement elevation less than 3 feet above <br />adjacent high water mark. <br />Background <br />Applicant: Keith T. Harstad <br />.Location: Lot 6, Block 10, Oakwood Manor Terrace Plat 3 <br />(see attached location map) <br />Zoning: R-1, Single Family <br />Ordinance Regulations: <br />Section 7-152 of the New Brighton code states that no <br />building permit for the construction of any building <br />may be issued unless the elevation of the lowest <br />interior floor level, including any basement, is at <br />'least three(3) feet above the level of the adjacent. <br />body of water during a regional flow. <br />The applicant has been issued a building permit and has begun <br />construction of a single family home on .the lot shown on drawing <br />attached. The property certainly presents a somewhat unique <br />situation in that much of the lot is occupied by 2 existing <br />ponds. As a result of the lot situation tile.proposed home is <br />by design relatively small with no garage being proposed., <br />As can be seen-from the attahced City Engineer's report, the <br />high water mark for the ponds was 928.14. This would require <br />the basement elevation of the proposed home to be 931.14. <br />The applicant is proposing by his application that the basement <br />elevation be 929.00. In his attached memo the City Engineer <br />(Director of Public Works) has indicated that. based on <br />examination of the drainage area and water elevations, a base- <br />ment elevation of 930.00 may be reasonably safe: <br />The hardship the applicant could have occur is that raising <br />the basement elevation to 931.14 would require additional <br />fill and perhaps some retaining walls. <br />The tot situation would appear to have the elements for <br />consideration of a variance. The exact elevation of the lowest <br />house level would appear, however, to be an engineering <br />concern. The City Engineer has indicated that an elevation of <br />930.00 may be reasonably safe.. This is not to say that the home <br />issued by City Manager <br />
