VN-185 <br />Extract of Minutes <br />Board of Review- <br />May 22, 1978 <br />VN-185, Gary Huelsnitz <br />The City Planner stated he had nothing to add to the staff report. <br />Mr. Gary Huelsntz, applicant; was present to answer :questions. <br />Mr..Huelsnitz presented photographs.:. of the property and partially <br />constructed building. <br />Chairman Brown asked why the applicant had nottaken out the necessary <br />,permits . <br />-Mr. Huelsntz stated that the construction was to replace an older <br />shed and thought the permit was to onlyensure the proper location. <br />Mr. Huelsnitz stated that he thought there was no problem as he was <br />:going to user the. existing patio slab. <br />Chairman Brown stated that he felt there was a conflict in thee. <br />ordinance between. what is a structure and an accessory building. <br />Motion by Brown,. seconded by Lang to-waive-the reading and adopt:a <br />resolution making findings of -fact and recommending approval of <br />VN-:185. <br />.Commissioner Anderson stated he found it difficult to find warrants <br />to grant the variance. <br />Commissioner Medved ..stated that he felt. the. staff analysis was <br />appropriate. He noted the recent Council and Planning Commission <br />action in regard. to Falcon Oil-where a canopy wasdetermined to be <br />- a structure. He also stated -that if there is- a problem with the <br />ordinance, the Council should either clarify the situation or amend <br />the ordinance. <br />Commissioner Lang stated that he felt the construction was compatible <br />with the area and .that the variance should be granted:. Lang. noted <br />that the property is we l`1 landscaped and that -the building. is not <br />read i y v is ib l.e .` ' He asked if the old shed- was going to be removed . <br />Mr,'Huelsnitz replied that the old storage building would be removed <br />shortly. <br />Commissioner Williams stated that -the hardship the Board of Review.. . <br />should consider is what hardship` the applicant would feel if the:` <br />shed-had not already been built. Williams"stated he felt this <br />Board should not be deciding the hardship after the fact. <br />
