VN-185 Extract of Minutes Board of Review- May 22, 1978 VN-185, Gary Huelsnitz The City Planner stated he had nothing to add to the staff report. Mr. Gary Huelsntz, applicant; was present to answer :questions. Mr..Huelsnitz presented photographs.:. of the property and partially constructed building. Chairman Brown asked why the applicant had nottaken out the necessary ,permits . -Mr. Huelsntz stated that the construction was to replace an older shed and thought the permit was to onlyensure the proper location. Mr. Huelsnitz stated that he thought there was no problem as he was :going to user the. existing patio slab. Chairman Brown stated that he felt there was a conflict in thee. ordinance between. what is a structure and an accessory building. Motion by Brown,. seconded by Lang to-waive-the reading and adopt:a resolution making findings of -fact and recommending approval of VN-:185. .Commissioner Anderson stated he found it difficult to find warrants to grant the variance. Commissioner Medved ..stated that he felt. the. staff analysis was appropriate. He noted the recent Council and Planning Commission action in regard. to Falcon Oil-where a canopy wasdetermined to be - a structure. He also stated -that if there is- a problem with the ordinance, the Council should either clarify the situation or amend the ordinance. Commissioner Lang stated that he felt the construction was compatible with the area and .that the variance should be granted:. Lang. noted that the property is we l`1 landscaped and that -the building. is not read i y v is ib l.e .` ' He asked if the old shed- was going to be removed . Mr,'Huelsnitz replied that the old storage building would be removed shortly. Commissioner Williams stated that -the hardship the Board of Review.. . should consider is what hardship` the applicant would feel if the:` shed-had not already been built. Williams"stated he felt this Board should not be deciding the hardship after the fact.
