In terms of <br />constructing a home, the above noted actions .mean that to meet <br />ordinance setback requirements the new .home must be setback 60 <br />feet further east than was expected at time of platting,. setting <br />the home also about 60 feet further east than the other homes <br />a long. Forest Dale Road, <br />The applicant made note of the property location and lot shape in <br />his application. .Further, the applicant has noted that meeting <br />the setback requirements may cause a problem for the existing <br />home to the south in that the rear yard of the existing home <br />would be adjacent to the front yard o£ the proposed home. Lastly, <br />the applicant has stated that meeting the setback requiremen is <br />creates problems in ,designing and locating a home meeting all <br />other zoning code requirements. <br />Overall,. the existing conditions (i.e., the offset cul-de-sac, <br />sound barrier, lot shape and setbacks of adjacent homes) would <br />appear to merit conside-ration of a variance. The variance <br />requested (17 ~eet) would not enable the new home to be built <br />aligning with the home to the south but the effect on the <br />neighboring property would-be reduced. The 30 ft. setback from <br />the curb would provide sufficient spacesto park a car in the <br />driveway. <br />The lot itself meets all code requirements in terms. of width and, <br />area and therefore the issue is at what setback shall a home be <br />constructed and not whether a home should be built at all. <br />STAFF.RECOMMENDATION <br />Staff recommends that VN-189, be approved by waiving the reading <br />and adopting .the attached resolution at their meeting of July 31st. <br />The Board of Review adopted the attached Planning Commission <br />resolution `recommendating approval of VN-189.
