The applicants and Byram and Marie Erwin propose that if the <br />City Council grants the two variances as hereinabove set forth <br />they will have the garage moved back west a minimum of 7.1 feet <br />so as to bring the structure within the side setback requirements <br />of five feet as required by the zoning ordinance. The Erwins request <br />the Planning Commission and City Council to permit a permanent <br />easement for driveway purposes across Tract A to permit access <br />to Byram Erwin's garage from the east. <br />The proposed easement would be a minimum of 20 feet in <br />width, and the legal description as determined by survey would be <br />recorded on both pieces of property. The proposed easement is <br />identified as Exhibit "3" in red. <br />The only other alternative for Byram Erwin which would permit <br />access to his garage would be to move the garage to face north <br />which would require him to expend considerable sums of money in <br />having the garage turned, a new slab laid and a driveway put in <br />extending from Spring Creek Drive to the garage. <br />The Erwins submit that permiting an easement for driveway <br />purposes over Tract A as proposed in Exhibit "3" would not be a <br />substantial burden on the proposed Tract A of Shirley and Robert <br />Erwin when considering the total area of this lot will approximate <br />30,000 square feet. Additionally, since the applicants intend <br />to place their home on the southern most portion of Tract A, the <br />driveway easement should in no way interfere with the enjoyment <br />and use of their property. <br />The proposed easement would be a great benefit to Byram Erwin
