structure is canted so that only the northeast corner of the <br />home comes within 4.3 feet of the proposed lot line dividing the <br />two tracts, the southeast corner being 5.2 feet from the proposed <br />lot line. Applicants submit that By ram and Marie Erwin have no <br />objection to this slight deviation of .7 feet in the side set- <br />back requirements of 5 feet. The existing home has its main <br />entrances on the west side away from the proposed lot line. The <br />letter attached as Exhibit "2" prepared by Mr. M.O. Watson, Civil <br />Engineer and Appraiser, who was consulted by Bryam, Robert and <br />Shirley Erwin, with respect to the subject property, further <br />explains the characteristics of the existing home of Byram Erwin. <br />In conclusion, applicants request two variances as follows: <br />(1) division of the proposed tract "A" into a.lot 73.5 feet in <br />width extending from Spring Creek Drive to the South line of the <br />property. <br />(2) permitting the proposed west line of applicants' tract "A" to <br />come within 4.3 feet of Byram and Marie Erwin's northeast corner <br />of their existing home instead of the minimum five feet required <br />by the zoning code. <br />The two requests for variances as hereinabove set forth if <br />granted would still leave the problem of Byram and Marie Erwin's <br />garage encroaching on the applicant's proposed lot. By dividing <br />the land into two tracts 73.5 feet in width this garage would <br />encroach 2.1 feet on its northeast corner and 1.8 feet on its <br />southeast corner of the applicant's lot. See Exhibit 1. This <br />garage is a large 3 car unit which Byram Erwin uses to store large <br />amounts of miscellaneous equipment as well as his automobile.
