<br />r <br />Report #78-'243 <br />September 21, 1978 <br />' APPLICATION FOR VARIANCE, <br />NON-CONFORMING USE PERMIT AND BUILDING PERMIT <br />VN-193, NC-34, LP-73 <br />HEARING TIME <br />7:35 P.M. <br />PURPOSE <br />To consider application for a building expansion. <br />BACKGROUND <br />APPLICANT: Industrial Sprink ler Corporation <br />LOCATION: 750 First Street S.W. (Corner of 1st <br />Street S.W. and 8th Avenue S.W.) <br />Zoning: I-2, Heavy Industrial <br />The applicant is seeking to add a 39' X 100' addition to the <br />rear or north side of their existing building. <br />A variance is required as the rear yard setback is requested <br />to be 10 feet rather than 20 feet as required in industrial <br />districts. The applicant has indicated that the proposed <br />addition would be used for semi-truck maintenance and pickup <br />truck fleet maintenance. The applicant has further stated <br />that the proposed location and shop size is required for <br />these purposes. The applicant has noted that a natural <br />earth berm along their rear property line has rendered their <br />rear yard useless and that the addition would come to the <br />edge of the slope. <br />A circumstance that could be considered is that the property has <br />been developed with the cons truction of a building located <br />on the far eastern side of a+large rectangular parcel. This <br />prior development now presents a situation where expansion <br />of the building to accomplish the-task desired can only be <br />achieved by encroaching into the rear yard. The earth berm <br />in the rear also minimizes the variance as this area could <br />not be used for parking or driveway. Overall, the variance <br />appears to be justified. <br />The addition also necessitates that a non-conforming use <br />permit be approved as there are several Type IV non- <br />conformities existing on the property.
