r <br />RESOLUTION D10. <br />STATE OF ~'~lINNESOTA <br />COUPITY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE <br />APPLICATION VN-196 <br />WHEREAS, an application for a variance VN-196 has been <br />made by Mr. Clirit`Carlson for property at 131 512th Avenue N.W. <br />to permit the subdivision of property having less than the <br />required width and not having frontage on a public street, and <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1. That an application for VN-196 .was filed with the <br />City October 10, 1978; <br />2. That the Board of Review heard and reviewed the <br />application at its meetings on October 17, 1978, <br />November 16, 1978 and November 21 ,. 1978; <br />3. That the City Council pursuant to published and mailed <br />notices, held a public hearing on November 28, 1978 <br />to consider the application.- All persons present were <br />given an opportunity to be heard. <br />4. That the written comments and analysis of the Director <br />of Community Development and City Planner, the <br />Planning Commission minutes, and all person's statemen <br />made at the public hearing were considered. <br />'NOW THEREFORE BE IT RESOLVED by the City Council of clew <br />Brighton that the following Findings of Fact are made in respect <br />to VN-196. <br />1. That the property is uniquely situated adjacent to Long <br />Lake and at the end of two (2) publicly dedicated <br />and improved streets. <br />2. That the proposed lots while being less than the <br />required width would have substantially greater. amounts <br />of square footage and the amounts of land area above <br />the water elevation would also exceed the 10,000 square <br />foot minimum requirement for a R-1 District. <br />3. That the. dedication of street right-of-way provides <br />the .city with the opportunity if desired to provide a <br />public street~to adjacent vacant/undeveloped property <br />to the west and north of the property in question. <br />4. That providing the lot is properly planned and <br />developed drainage should not be a problem. <br />5. The construction of a single family home on the propos <br />southern lot should not have a detrimental effect on <br />adjacent property or property values. <br />6. That the property has some unique characteristics in <br />terms. of location and in terms of shape and topography <br />with a considerable slope from the proposed house <br />location to the lake. <br />7. -That the impact or effect of the lot width deviation <br /> is lessened as a result of the increased lot area. <br />8. ~~~'~ P,`r~k o'~ p~~~~ <br />
