Report #78-281 <br />November 22, 1978 <br />Page #2 <br />over the dedicated right-of-way. -The use of the existing 8 <br />foot driveway by one additional home would appear to have a <br />minimal effect on traffic in the area. <br />The City Engineer has reviewed the topographical data supplied <br />by the applicant and it is his opinion that drainage should not <br />be a problem provided the lot is adequately graded. <br />The question of whether or not the warrants existed for sub- <br />dividing the property into two lots having less than the <br />required width also was questioned at the Council public hearing. <br />The applicant in his statement has stated that while the lots <br />will be slightly less than the required 75 feet the overall area <br />greatly exceeds that required by ordinance. The applicant has <br />further stated that the use of the one parcel is impractical <br />due to its potential value. <br />The question whether or not warrants are present in this case <br />is of prime importance, In the past variances have been <br />approved where a lot had less than the reduced width but the <br />overall area greatly exceeded the minimum required by ordinance. <br />This case presents that situation where the area does exceed the <br />minimum though in this case a good portion of property is <br />actually under water. The amount of land-above water is however <br />still above the 10,000 square foot minimum. This variance is <br />is also complicated in that the applicant is also requesting a <br />variance for not having frontage on a public street. .The <br />applicant is attempting to rectify or remedy that situation by <br />dedicating a certain amount for road right-of-way. The trade <br />off proposed appears to be a good one as half the standard <br />right-of-way would be available if it were decided to install <br />a public road going north. At the same time the .applicant could <br />make a better utilization of this very valuable lake shore <br />property. <br />See Report #78-235 for additional comment. <br />RECOMMENDATION <br />Staff recommends that VN-196, Carlson be approved by waiving <br />the reading and adopting the attached resolution. <br />The Board of Review at its regular meeting November 21, 1978 <br />moved that the application VN-196, Carlson be forwarded. to the <br />City Council without a recommen tion. <br />~• <br />J M.
