n... RESOLUTION NO. STATE'OF MINNESOTA' COUNTY OF RAMSEY CITY -0F NEW.BRTGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE APPLICATION VN-197. WHEREAS,- anapplication for a Variance VN-197 has .been.. made by the R,C.E, Corporation to not install concrete curbs adjacent to a temporary .driveway. on property generally West. of Silver Lake Road, North of Rice Creek Road and South of the Rice Creek Center, and WHEREAS, the procedural history of .the application is as follows 1. That an application of VN-197 was filed with the City on October 5, .1978,. 2. That the Planning Commission, Board of Review considered the application at its meeting of October~l7, 1978. 3. That the City Council pursuant to published and mailed notices, held .a public hearing on November 14, 1978 to consider the application. All person's, present were given an opportunity to be heard. 4. That the written comments and analysis of the Director of Community Development, the Planning Commission recommendation and all person's statements-made at the public hearing were considered. NOW 'THEREFORE BE IT RESOLVED by the. Council of the City of New Brighton the following Findings of Fact are made in regard to VN-197: 1. That the City Council has approved a temporary drivewa! on the property with a one (1) year limitation and subject to Council review and consideration after -one (1) year to determine whether or,not the driveway would be permitted for a second year, 2. That the temporary nature of the driveway creates a unique circumstance and a possible hardship to the applicant if the driveway were abondoned after one (1) year. BE IT FURTHER RESOLVED, that VN-197 is and hereby approved subject to the following condition: 1. That the Variance be subject to Council review after one (l) year. Adopted this.' .day of 1978.
