_.. <br />.~w~ , ...~. _ ..,~,. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br />OF VARIANCE APPLICATION VN-197. <br />i <br />WHEREAS, an application .fora Variance VN-197 has been <br />made by the R.C.E. Corporation to not install ,concrete curbs <br />adjacent to a temporary driveway on property generally West <br />of Silver Lake Road, North of Rice Creek Road and Sou h of <br />the Rice .Greek Center, and <br />WHEREAS, the procedural history of the application is <br />as follows: <br />1. That an application of VN-197 was filed with the <br />City on October 5,;1978. <br />2. That the Planning Commission, Board of Review <br />considered the application at-its meeting of <br />October 17, 1978. <br />3. That the written comments and analysis of the <br />.:Director of Community Development and all person's <br />statements made at the Board of Review meeting <br />were considered. <br />NOW THEREFORE BE TT RESOLVED by the Board of Review that <br />the following Finding of Fact are made in regard to VN-197: <br />1. That the. City Council has approved a temporary <br />driveway on the property with a one (1) year <br />limitation and subject to Council review and <br />consideration after one (1) year.. to determine <br />whether or -not the driveway would be permitted <br />fora second year. <br />2. That the temporary nature of the driveway <br />creates a unique circumstance and a possible <br />hardship to the applicant if the driveway <br />were abandoned after one ~;(1) year. <br />BE IT FURTHER RESOLVED, that the Board of Review hereby <br />recommends that VN-197 be approved subject to the following. <br />conditions: <br />1.
