ew <br />righton <br />PURP08E <br />Report #79- 337 <br />March 5, 1979 <br />REPORT TO THE CITY COUNCIL <br />APPLICATION FOR VARIANCE <br />VN-202, CARLEY FOUNDRY <br />To .consider an application of Carley Foundry to .permit parking <br />in a side street yard in an industrial district. <br />BACKGROUND <br />APPLICANT: Carley Foundry <br />LO TIONs. .808 1st Street S.W., generally north of 1st <br />S.W., west of 8th Avenue S.W. and east of Old <br />Highway #8. <br />ZONING: I-2, Heavy Industrial <br />The applicant is proposing to create a 20' x 48' parking area <br />on the east side of the existing structure in order to park two <br />truck trailers side by side. A variance is required because <br />the zoning code states that off-street parking is not permitted <br />in a side street yard. <br />As indicated by the attached site plan, the applicant is <br />presently using the front yard for customer parking and the <br />rear yard for employee parking. The applicant obtained a <br />variance from the City in 1973 to allow the front yard parking. <br />The eastern portion of the site. is sodded and the parking area <br />would reduce this strip by 20' which would result in a 20' <br />landscaped .area adjacent to the parking area. <br />According to the New Brighton Zoning Code, the City Council can. <br />allow a modification of the literal provisions of the ordinance <br />by granting a variance if the applicant demonstrates that there <br />are undue hardships or unique circumstances. In this specific <br />variance request the applicant has a somewhat unique circum- <br />stance ire the fact that the site is enclosed on three sides by <br />public streets and bounded to the rear by railroad right-of-way. <br />The applicant indicates that a hardship would result if the <br />additional parking was not permitted because the parking space <br />is necessary to the operation of the business. <br />issued ~y ~ Mpnsyer <br />
